Do you think that pregnant women who abuse substances should be treated as criminals?
I swear some lawyer is going to win millions one day suing in court because their client's mother smoked and drank alcohol during pregnancy...

Yes, sure. So long as the law defines substance abuse properly. Perhaps it isn't the healthiest thing, but I think an expecting mother having a beer every few days isn't something that should be punished.

If the baby does not know it is alive, it is not sentient. It has no rights as a citizen as should not be considered as one. Let them take all the drugs they want.

Assuming that wasn't directed at the OP, and even if it was, i'll go with no. Why? Second hand smoke I think is seriously overhyped. Smoking when pregnant, however is a different issue.

If it was illegal substances, then they should be charged as normal. If it was legal then there shouldn't be any punishment for doing something fully within your rights. Talk about discrimination, just because you are carrying a fertilized egg doesn't mean you lose your rights.

Healthy? If you insist.... I may be mentaly insane, but my latest trip to the doctorb shows I'm healthy EDIT: I agree with morty and thaddius, just because your pregnant doesnt mean your rights should change, but if you seriously harm your baby, criminal neglegence isnt illiogical.

Well personally I think they should just ban cigerettes outright. Those darn things are so addictive, they cause so many problems, and I myself would never have started smoking had it not been such a trendy endorsement of pop culture.... *too early in the morning to think, but you know what I mean :] Regardless I think if a child does sustain damage from growing up in a smokefilled house, and s/he can link the damage suffered to growing up in a smokefilled house, then s/he should certainly be entitled to some means of compensation.

Those darn things are so addictive, they cause so many problems, and I myself would never have started smoking had it not been such a trendy endorsement of pop culture.... *too early in the morning to think, but you know what I mean :] Either outlaw tobacco or legalize some other drugs, because there are plenty out there that are far less harmful. I agree with that, but there needs to be a limit so we don't have ridiculously high settlements. Ha, like in the malpractice lawsuits...
